1. Legal Identity

RKLSwims is a trading name of RKLSwims Education Ltd (Company No: 17044687).

All paid swimming and water safety lessons are delivered by RKLSwims Education Ltd.

Community and grant-funded programmes may be delivered separately by RKLSWIMS C.I.C. (Company No: 16203384) and are governed by separate arrangements.

These Terms apply to all paid services provided by RKLSwims Education Ltd.

2. Eligibility & Booking

By booking a lesson, you confirm that:

You are 18 years or older; or
You are booking on behalf of a child for whom you have parental responsibility.

All bookings must be made through our website or approved booking platforms.

A booking is confirmed only when payment is received.

3. Payments

3.1 Payment Terms

Payment must be made in advance of lessons via our approved payment provider (e.g., Stripe or authorised booking platform).

For subscription plans, payments are taken automatically on a recurring basis until cancelled.

3.2 Cooling-Off Period (Consumer Rights)

If you book online, you have a statutory 14-day cooling-off period under the Consumer Contracts Regulations 2013.

However, if lessons begin within that 14-day period, you agree that services may commence, and you may be charged proportionally for sessions delivered.

4. Cancellations & Refunds

4.1 Customer Cancellation

Group lessons:

Fees are non-refundable for missed sessions.
Missed sessions cannot be carried forward unless otherwise agreed.

Private lessons:

A minimum of 10 days' notice is required to cancel or reschedule.
Failure to provide notice may result in full charge.

Subscription plans:

Cancellation must be made at least 10 days before the next billing date.
Cancellation stops future payments but does not refund past payments.

4.2 Company Cancellation

If RKLSwims Education Ltd cancels a lesson due to:

Instructor illness
Pool closure
Safety concerns
Unforeseen circumstances

You will be offered:

A replacement session, or
A refund where rescheduling is not possible.

Refunds will be processed to the original payment method within 10 working days.

5. Medical Information & Responsibility

Parents/guardians must disclose:

Medical conditions
Additional needs
Behavioural considerations
Allergies or health risks

Failure to disclose relevant medical information may affect our ability to ensure safe participation.

Parents remain responsible for:

Children in changing areas
Supervision before and after lessons
Collection promptly at session end

6. Attendance & Behaviour

Swimmers must:

Follow instructor guidance
Avoid running on poolside
Respect other swimmers

RKLSwims Education Ltd reserves the right to:

Remove a swimmer from a session for unsafe behaviour
Suspend participation where behaviour poses risk

No refund will be provided for removal due to misconduct.

7. Photography & Media

Photography by parents is not permitted unless authorised by the venue.

RKLSwims may take promotional images only with prior written parental consent.

8. Health & Safety

RKLSwims Education Ltd is responsible for lesson delivery and supervision during sessions.

The venue operator remains responsible for:

Building safety
Pool plant
Water quality
Lifeguard provision
Changing room management

Participation in swimming carries inherent risk. By booking, you acknowledge these risks.

Nothing in these Terms excludes liability for:

Death or personal injury caused by negligence
Fraud or fraudulent misrepresentation
Any liability that cannot legally be excluded

9. Limitation of Liability

To the extent permitted by law, RKLSwims Education Ltd shall not be liable for:

Loss of personal belongings
Indirect or consequential loss
Loss of profits or revenue

Our total liability shall not exceed the total fees paid for the relevant lesson block.

10. Data Protection

RKLSwims Education Ltd acts as the Data Controller for paid lesson participants.

Personal data is processed in accordance with our Privacy Policy and Data Protection policies.

We do not sell personal data.

11. Intellectual Property

All content, branding, teaching materials and website content remain the property of RKLSwims Education Ltd or its licensors.

You may not reproduce or distribute materials without written permission.

12. Complaints

Complaints will be handled in accordance with our Complaints Procedure, available on request or via our website.

13. Amendments

RKLSwims Education Ltd reserves the right to update these Terms.

Updates will be published on our website.

Continued use of services constitutes acceptance of updated Terms.

14. Governing Law

These Terms are governed by the laws of England and Wales.
